These Terms of Service (“Terms”) govern your access to and use of Noodle Story (“the Game”), a single & multiplayer interactive game accessible through Discord. By accessing or using Noodle Story, you agree to be bound by these Terms.
1. Definitions
Developer refers to Erma Starling, the sole developer and owner of Noodle Story.
User or you refers to any individual who accesses or uses Noodle Story.
Discord refers to the third-party platform through which Noodle Story is accessed.
2. Eligibility
You must be at least 13 years of age or the minimum age required by applicable law to access Discord and web-based services. By using Noodle Story, you represent and warrant that you meet this requirement and have the legal capacity to enter into these Terms.
3. License to Use
Subject to compliance with these Terms, the Developer grants you a limited, non-exclusive, non-transferable, revocable license to access and use Noodle Story through Discord for personal, non-commercial purposes.
4. User Conduct
You agree not to:
Interfere with or disrupt the Game or its operation.
Attempt to gain unauthorized access to the Game or its systems.
Use bots, automation tools, scripts, or exploits.
Harass, threaten, or abuse other users.
Post or transmit content that is unlawful, harmful, or otherwise objectionable.
5. Ownership and Intellectual Property
All content, including but not limited to game mechanics, artwork, code, characters, and lore, is the exclusive property of the Developer. Users may not copy, reproduce, distribute, or create derivative works based on the Game without prior written consent from the Developer.
6. Virtual Content and In-Game Purchases
a. Description of Content
Noodle Story may offer users access to virtual content, including but not limited to in-game currency (“Coins”), virtual items (recipes, badges, specializations, collections).
b. Acquisition
Virtual Content may be obtained through gameplay, participation in events, or purchase with real-world money through authorized payment processors. All purchases are final and non-refundable unless required by applicable law.
c. License and Use
When you acquire Virtual Content, you are granted a limited, non-exclusive, non-transferable, revocable license to use that Virtual Content solely within Noodle Story for personal, non-commercial gameplay purposes. You acknowledge that you do not own the Virtual Content, and you may not sell, trade, transfer, or exchange it outside of the Game or for real-world currency.
d. Availability and Changes
The Developer reserves the right to modify, suspend, or remove any Virtual Content at its sole discretion. This includes adjusting availability, pricing, or functionality to maintain game balance and overall experience.
e. No Cash Value
Virtual Content cannot be exchanged for cash, goods, or services outside Noodle Story, except where required by law.
7. Third-Party Platforms
Noodle Story operates within the Discord platform. Your use of Discord is subject to Discord’s own terms of service and policies. The web version may utilize third-party services, which may have their own terms. The Developer is not responsible for any acts or omissions of these third parties.
8. Data and Privacy
Noodle Story does not collect personal data beyond that which is accessible via Discord APIs for gameplay purposes (e.g., user ID, username). No data is sold, traded, or transferred to third parties. For more details, please refer to the Noodle Story Privacy Policy.
9. Disclaimers
Noodle Story is provided “as is” and “as available” without warranties of any kind. The Developer disclaims all warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. The Developer makes no guarantee that the Game will be uninterrupted, error-free, or secure.
10. Limitation of Liability
To the fullest extent permitted by law, the Developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, or goodwill, arising from or related to your access to or use of Noodle Story.
11. Termination
The Developer may suspend or terminate your access to Noodle Story at any time, without notice or liability, for conduct that violates these Terms or is otherwise deemed harmful to the Game or its community.
12. Modifications to Terms
The Developer reserves the right to modify these Terms at any time. Updated Terms will be made available through the Game or its associated channels. Continued use of Noodle Story constitutes acceptance of the modified Terms.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the Developer resides, without regard to its conflict of law principles.
